The Bay Area gas water heater ban is a zero-NOx emissions standard — BAAQMD Regulation 9, Rule 6 — and as the rule currently stands it applies to residential water heaters manufactured on or after January 1, 2027. In practice that means when your gas water heater dies and you replace it, the replacement has to be a zero-NOx unit, which today means a heat pump water heater. It is not a ban on the water heater already in your garage, and nobody is going to make you rip one out.
There is one thing every article written before this summer gets wrong: in July 2026 the Air District published draft amendments that would push the residential deadline from January 2027 to January 1, 2028, add exemptions, and move small units under 35 gallons out to 2031. Those amendments have not been adopted yet — the Board is expected to vote in the fall of 2026. So the honest answer for a Santa Rosa homeowner today is that 2027 is the law on the books, 2028 is the likely landing spot, and neither date changes what you should actually do.
What does the rule actually ban?
It bans the sale of new natural-gas water heaters that emit NOx — not the use of the one you already own. This is the distinction that causes the most panic, so it is worth being precise about.
BAAQMD Regulation 9, Rule 6 was amended in March 2023 to set a zero-NOx standard for newly manufactured water heaters. NOx — oxides of nitrogen — is the pollutant that comes out of a gas burner and contributes to the smog and respiratory problems the Air District is charged with reducing. The rule does not say you must go electric. It says a new unit must emit zero NOx. As of today, the only appliances that meet that standard commercially are electric, and for water heating that means a heat pump.
Three things it does not do:
- It does not affect a water heater already installed in your home. Keep it, repair it, run it until it fails.
- It does not require you to replace anything on a schedule. The trigger is replacement, not a calendar.
- It does not apply to your furnace on the same date — furnaces sit under Rule 9-4 with its own timeline.
The companion date worth knowing: larger units between 75,000 BTU/hr and 2 million BTU/hr — most commercial and multifamily equipment, and a good number of gas tankless models — are set for January 1, 2031.
Is the deadline 2027 or 2028?
As of September 2026: the adopted rule says January 1, 2027, and a draft amendment published in July 2026 would move it to January 1, 2028. The Board has not voted yet. Anyone telling you flatly that it is 2027, or flatly that it has been delayed, is quoting half the picture.
Here is the actual state of play. The Air District published draft rule language in July 2026 after sustained pushback on cost and equipment availability. The draft would:
- Delay the residential deadline by one year, from January 2027 to January 2028.
- Move water heaters under 35 gallons and hydronic units out to January 1, 2031, to give the market time to catch up.
- Add three exemption categories — income-qualified households (including Medi-Cal and CalFresh participants, and households spending over 28% of income on housing); homes without the physical space or ventilation for a compliant unit; and homes with electrical constraints, specifically panels under 100 amps, insufficient capacity, or a run over 50 feet to reach the new unit.
Those exemptions matter more than the date does. Two of the three — space and electrical capacity — describe a very large number of older North Bay houses. If your garage panel is a 100-amp box that is already full, the draft rule anticipates exactly that situation.
Does this rule even apply to my house?
Not everywhere we work is covered — Sonoma County is split between two air districts, and only one of them is BAAQMD. This is the single most useful thing on this page for our customers, and almost nobody mentions it.
Santa Rosa is inside the Bay Area Air Quality Management District, so the rule applies here. So do Petaluma, Rohnert Park, Cotati, Sonoma, Sebastopol and the Marin County cities we serve.
But the northern and coastal parts of Sonoma County fall under the Northern Sonoma County Air Pollution Control District — a separate agency with its own rules. Per the County's own breakdown, that district covers Cloverdale, Healdsburg, Geyserville, Guerneville, Forestville, Monte Rio, Cazadero, Jenner, Bodega and Bodega Bay, The Sea Ranch and Annapolis, among others, plus small portions of Windsor and Sebastopol.
BAAQMD's water heater rule is a BAAQMD rule. It does not automatically apply in the Northern Sonoma district. If you are in Healdsburg or out toward the river and the coast, you are very likely not subject to this deadline at all — though state-level rules can still change that picture later, and the boundary runs through some towns rather than around them.

What is a heat pump water heater?
A heat pump water heater does not make heat — it moves heat that already exists in the air into your water. That is the whole idea, and it is why the efficiency numbers look impossible at first glance.
A conventional gas or electric water heater generates heat: it burns fuel, or it runs current through a resistance element. Either way you are converting energy into heat, and the best you can ever do is break even.
A heat pump water heater works like a refrigerator running backwards. A fan pulls in ambient garage or basement air, a refrigerant circuit absorbs the low-grade heat that air is already carrying, a compressor concentrates it, and that heat goes into the tank. You are not paying to create the heat — you are paying only for the electricity to move it. That is why it can deliver more heat energy than the electrical energy it consumes, without breaking any laws of physics.
Two practical side effects worth knowing before you commit: the unit cools and dehumidifies the space it sits in (welcome in a garage in August, less so if the heater lives in a conditioned closet), and it makes noise roughly comparable to a window air conditioner, because there is a fan and a compressor running.
Is 300% efficiency real?
Yes — and the reason it is not a marketing exaggeration is that efficiency over 100% is measuring something different than you think. A heat pump water heater commonly delivers around three units of heat for every one unit of electricity it draws. Engineers call that a coefficient of performance, or COP, of about 3.
That figure is not claiming the appliance creates energy. It is a ratio of heat delivered to electricity consumed, and because most of the heat was already sitting in the surrounding air for free, the ratio comes out well above one. A resistance electric water heater sits at a COP of about 1. A gas unit is below that once you account for what goes up the flue.
The emissions side is equally straightforward: there is no combustion, so at the appliance there is no NOx, no flue gas, no carbon monoxide risk and no gas line. That is what zero-NOx means in the rule, and it is why heat pumps are currently the only realistic way to comply. Worth stating plainly, because some of the marketing overreaches: the electricity still has to come from somewhere, so the total emissions picture depends on the grid. At the house, though, the burner is gone.

What does it cost, and what does the install involve?
A heat pump water heater costs more to install than a like-for-like gas swap and less to run, and the install is usually more involved because of the electrical work. Being straight about that is more useful than pretending the switch is painless.
For comparison, here are our current published figures for the conventional options, verified September 2026:
- Gas or electric tank replacement, 40–50 gallon, like-for-like — $2,500–$2,850
- Navien tankless unit, installed — $5,400–$6,500
- Diagnostic fee, credited against the job if you go ahead — $45
Three things drive the cost above a straight tank swap:
- Electrical. A heat pump water heater needs a 240-volt circuit. If your panel has capacity and the run is short, this is modest. If the panel is full or undersized, it is a bigger job — and electrical work is a C-10 licensed trade. We are a C-36 plumbing contractor, so panel and circuit work is done by a licensed electrician alongside us, not by us. We will tell you up front which situation you are in.
- Space and air. The unit needs enough surrounding air volume to draw heat from, or a ducting kit if it is going somewhere tight. Manufacturers specify a minimum room volume for each model.
- Condensate. A heat pump pulls moisture out of the air, so it needs a condensate drain — something a gas heater never required.
On the other side of the ledger, the running cost is meaningfully lower, and there are federal, state and utility incentives for heat pump water heaters. We have deliberately not printed incentive figures here — those programs change often enough that a number published today can be wrong by the time you read it, and quoting a stale rebate is worse than quoting none. Ask us when you call and we will point you at what is current.
What should you do before the deadline?
If your water heater is healthy, do nothing yet. If it is over ten years old, start planning now — not because of the date, but because the worst time to make this decision is the morning it fails.
That is the real risk in this rule change, and it has nothing to do with politics. A water heater that dies on a Saturday turns into an emergency, and an emergency is exactly when you have no time to check whether your panel has capacity, get an electrician scheduled, or compare a heat pump against a tank. People in that position take whatever can be fitted that day.
So the sensible sequence:
- Find out how old yours is. The manufacture date is encoded in the serial number on the label — and see how long a water heater lasts for what to expect.
- Check your electrical panel while there is no urgency — amperage, and whether there are free breaker spaces.
- Look at where it lives. Garage with room around it is close to ideal. A sealed interior closet is the case that needs planning.
- Decide in advance what you would install, so a failure is a phone call and not a research project. If it is already leaking, that decision is closer than you think.
If you are in the Northern Sonoma air district, this is much less pressing — but the age question still applies.
Frequently asked questions
Do I have to replace my gas water heater in 2027? No. The rule applies to newly manufactured units, not to the one already installed in your home. You can keep and repair an existing gas water heater. The requirement only bites when you replace it.

These are proposed, not yet adopted.
Is a heat pump water heater really 300% efficient? Roughly, yes.
